This Privacy Policy (the “Privacy Policy”) is intended to describe the practices of Quantum Computing Center Ltd., and its affiliates (“QCC”, “we”, “us” or “our”) regarding the information and personal information we may collect in connection with (i) the use of QaaS and related services, including as applicable the TestBed services (as defined in the IQCC Subscription Terms of Use available at: https://i-qcc.com/iqcc-subscription-terms-of-use/; “IQCC Terms”) and may be accessible via of our website at: https://i-qcc.com/ (the “Website”); (ii) our marketing and related activities, including registrations as part of our webinars, conferences, events, emails, customer success activities, etc.; (iii) other QCC services, features, and offerings, we may offer from time to time to our customers; and (iv) any other product or activity that links to or otherwise references this Privacy Policy (collectively, including without limitation the Website, QaaS, and Testbed Services, the “Services”).

We are committed to the privacy of the individuals who are visitors and/or users of our Services, including users of our Services who are authorized users of our business customers (collectively, the “User(s)” or “you”) and are committed to protect the personal data that our Users share with us, in compliance with applicable privacy and personal data laws and regulations.

PLEASE READ CAREFULLY THIS PRIVACY POLICY BEFORE ACCESSING AND USING OUR SERVICES. BY ACCESSING OR USING OUR SERVICES YOU ARE ACCEPTING THE PRACTICES DESCRIBED IN THIS PRIVACY POLICY. IF YOU DISAGREE WITH ANY TERM PROVIDED HEREIN, DO NOT ACCESS OR USE THE SERVICES. IF OUR SERVICES ARE BEING USED BY YOU ON BEHALF OF YOUR EMPLOYER OR ANOTHER ORGANIZATION YOU ARE ACTING FOR, SPECIFICALLY WHAT SUCH ORGANIZATION IS OUR CUSTOMER OR PROSPECTIVE CUSTOMER (“CUSTOMER”), YOU ACKNOWLEDGE AND AGREE THAT WE WILL BE COLLECTING AND PROCESSING YOUR INFORMATION ON THE INSTRUCTIONS OF SUCH CUSTOMER, FOR THE PURPOSE OF PROVIDING OUR SERVICES TO SAID CUSTOMER.

PLEASE NOTE: YOU ARE NOT OBLIGATED BY LAW TO PROVIDE US WITH ANY PERSONAL DATA. HENCE, YOU HEREBY ACKNOWLEDGE AND AGREE THAT YOU ARE PROVIDING US WITH PERSONAL DATA AT YOUR OWN FREE WILL, FOR THE PURPOSES DESCRIBED IN THIS PRIVACY POLICY, AND THAT WE MAY RETAIN AND USE SUCH PERSONAL DATA IN ACCORDANCE WITH THIS PRIVACY POLICY AND ANY APPLICABLE LAWS AND REGULATIONS.

WHAT INFORMATION DO WE COLLECT FROM OUR USERS?

We may collect several types of information from and about our Users. In this Section, we describe the categories of information which we may collect, and the applicable circumstances under which such collection is performed.

First – What is personal data?

Personal information refers to identifiable information regarding an individual, namely information that identifies an individual or may with reasonable efforts or together with additional information we have access to, enable the identification of an individual, or may be of private or sensitive nature information, relating to an identified or identifiable natural person. Identification of an individual includes an association of such individual with a persistent identifier such as a name, an identification number, a persistent cookie identifier, etc.

Personal information does not include information that has been anonymized or aggregated so that it can no longer be used to identify a specific natural person.

We collect personal data from you when you use or interact with our Services

We collect personal data from you and any devices (including mobile devices) you use when you: use, interact, or access our Services, provide us information on a web form or other text field within our Services, or through correspondence you and we conduct with each other.

More specifically we collect and use the following categories and types of information in the following respective circumstances:

Personal data Users provide us actively and voluntarily when they use or interact with our Website, Services, or Marketing Platform:

  • Contact information, such as name, email address, IP address, device identifier, organization identifiers, company, position, country, telephone number, and other personal information provided or otherwise made available to us in connection with or as part of (i) a user fills our online form or register for an account (if applicable) with us or when they update their account details; (ii) use of the our Services; and (iii) if you contacted us or contracted with us (also on behalf of your employer) in connection with the purchase of our products or services.
  • Information you voluntarily provide us, for example, when you register to one of our events, request that we contact you through our online forms, or when you request to receive certain content that we may make available like research and white papers.
  • Interaction with our services and with customer support, which may include information about your use of the services, information about your professional qualifications as required or ancillary to your (or the Customer you are acting on behalf of) the use of our services as well as text/video/audio recording and transcripts of such communications.
  • Information required by us in connection with your use of the Services, meaning information we ask Users to provide us to identify them, their beneficial owner (in case of Customers), including location, to make sure they are not subject to sanctions and such other restrictions imposed by law.
  • Information required or authorized by applicable national laws, meaning information we ask Users to provide us to authenticate or identify them or to verify the information we have collected or otherwise provide them with our Services.

Personal data we automatically obtain when Users use or interact with our Services:

This category refers to any information we obtain through the Services and which is derived, learned, or detected as a result of your access to and/or interaction with the Services, such as (i) Technical information with respect to the devices and software you use to access our Services such as operating system, browser type, and version, type of end-user device, device ID, etc.; (ii) Usability information with respect to your use of the Services and your engagement, such as clickstream, event and log data, page visits, and different segmentation we apply when we consider your engagement with our Services; (iii) Impression and attribution information which may include information concerning your navigations from and to our Services, such as HTTP referrals, IP address, advertiser ID.

  • Services Interactions. When Users access or interact with our Services, we perform an automatic collection of information through the use of cookies, web beacons, unique identifiers, and similar technologies which allow us to collect information about the pages and screens you view, the links you click, and other actions you take when using our Services, as further detailed in Section ‎7 below.

Keep in mind – Most devices allow you to control or disable the use of certain collectable information including location services, in the device’s settings menu.

Personal data collected from other sources

We may collect personal data concerning you, from third parties who have assured us that they have obtained your consent for such provision of information (including without limitation our customers). We may also have access to personal information as part of the data made available to us as part of providing our services to our customers.

Please Note – While most of the information we collect from you is not Personal data, we acknowledge that under certain jurisdictions the data we do receive when a User is using the Website may be deemed personal data as it is associated with a Technical Identifier, and therefore, where applicable, will be treated as such.

You have the right to choose how we collect and use your Information. See “Your Rights” in Section 11 below for more information.

THE PURPOSES

Lawful grounds for collecting information on our users

We collect and process your information for the purposes described in this Privacy Policy, based at least on one of the following legal grounds:

  • Contract: We collect and process your personal information in order to provide you with the Services, following your acceptance of the IQCC Terms and this Privacy Policy; to maintain and improve our Services; to develop new services and features for our Users; and to personalize the Service in order to deliver better user experience.
  • With your consent: We ask for your agreement to process your information for specific purposes and you have the right to withdraw your consent at any time. For example, we ask for your consent to provide you with personalized content and ads through the use of cookies;
  • Legitimate interests: We process your information for our legitimate interests, including performing a contract with, and providing our services for, our customers (on behalf of whom you are accessing. interacting and/or using our services) while applying appropriate safeguards that protect your privacy. This means that we process your information for things like detecting, preventing, or otherwise addressing fraud, abuse, security, usability, functionality, or technical issues with our services, protecting against harm to the rights, property or safety of our properties, or our users, or the public as required or permitted by law; Enforcing legal claims, including investigation of potential violations of this Privacy Policy; in order to comply and/or fulfill our obligation under applicable laws, regulation, guidelines, industry standards and contractual requirements, legal process, subpoena or governmental request, as well as our IQCC Terms.

We use Information for the following purposes:

  • To provide you with our Services and support which you have purchased from us (either on your own behalf or on behalf of your employer or the organization you are acting on behalf of), or on the instruction of your employer/organization who is a customer of our services, for the purpose of providing our services to such Customer.
  • To provide services to our customers (on behalf of whom you are using/accessing/interacting with our services).
  • To process your inquiries and to respond to your requests. For example, when you contact us to learn more about our products or services or when you request to receive certain materials from us (e.g. white papers, research papers, product, and services information).
  • To send you information related to our services and products that we believe may interest you, or your organization (our Customer) such as newsletters or product and service updates. Such communications will be sent to you when you have chosen to receive such communication or when we have a legitimate interest to market our products and services. In any event, you will always be able to opt-out of receiving such communications. Opting out may be done either directly in the communication received or through the ways described in the instructions in the “Your Rights” Section, at Section 11 below.
  • To understand how you have used our Services and to customize it in accordance with your interests and past actions and choices. We do this based on our legitimate interest to operate our Services, diagnosing any problems with the Services, and improving the experience when navigating through it.
  • In our legitimate interest to prevent fraud or harm to us or any third party, and ensure the security of our network and services.
  • Where it is necessary for QCC to comply with its legal obligations and to exercise and enforce its legal rights.
  • We may use certain third-party marketing and advertising networks to help us market our Services on third party websites (e.g. re-marketing ads across the Internet by Google).

WHERE DO WE STORE USER’S PERSONAL DATA?

Information regarding the Users will be maintained, processed and stored by us and our authorized affiliates and service providers in Israel, and as necessary, in secured cloud storage, provided by our third party service provider in Israel.

While the data protection laws in the above jurisdictions may be different than the laws of your residence or location, please know that we, our affiliates and our service providers that store or process your Personal data on the our behalf are each committed to keep it protected and secured, pursuant to this Privacy Policy and industry standards, regardless of any lesser legal requirements that may apply in their jurisdiction. You hereby accept the place of storage and the transfer of information as described above.

WHO DO WE SHARE USER INFORMATION WITH AND WHY?

We may share your Personal data with third parties (or otherwise allow them access to it) only in the following manners and instances:

  • To satisfy any applicable law, regulation, legal process, subpoena or governmental request, whenever we believes in good faith that it is legally bound to share such information.
  • To enforce this Privacy Policy and the Terms of Use including investigation of potential violations thereof.
  • To detect, prevent, or otherwise address fraud, security or technical issues.
  • To respond to User’s support requests.
  • To respond to claims that contact information or any other private or proprietary information (e.g. name, e-mail address, etc.) of a third-party has been used, posted or transmitted without their consent or as a form of harassment.
  • To protect the rights, property, or personal safety of us, our Users or the general public.
  • When we undergo any change in control, including by means of merger, acquisition or purchase of all or substantially all of its assets.
  • To collect, hold and/or manage Users’ Personal data through our authorized third party service providers, as contemplated hereunder, who may be located in Israel (for example: Classiq, AWS) and outside of Israel (for example: Google Analytics, Auth0). Such third party services providers may receive or otherwise have access to our Users’ Personal data, depending on each of their particular roles and purposes in facilitating and enhancing our Services and related services, namely, to allow serving of personalized content and the provision of the Services, and for analytics of the functionality and usability of our Services. and may only use it for such purposes.
  • Pursuant to your explicit approval prior to the disclosure.

We remain responsible for any personal information processing done by the service provider on our behalf, except for events outside of our and/or their reasonable control, and except with respect to service providers with whom you are contractually engaged, either through a prior separate contractual engagement and/or through acceptance of their privacy policy and terms of use in our data processing agreement with our customers. Specifically, each of our service providers which store or process your Personal Information either: (i) assured us that they provide adequate safeguards to protect your rights to privacy including where applicable, by undertaking to comply with the EU Standard Contractual Clauses; (ii) where applicable, hold, and process such information on our behalf in jurisdictions which have been determined to ensure adequate level protection by the EU Commission; (iii) perform such processing pursuant to your consent and acceptance of their privacy policy as further detailed in this Privacy Policy. For avoidance of doubt, we may share anonymized or de-identified information with any other third party, at our sole discretion.

USING COOKIES AND OTHER TRACKING TECHNOLOGIES

We use certain monitoring and tracking technologies, including ones offered by third party service providers. These technologies are used in order to maintain, provide and improve our Services on an ongoing basis in order to provide a better experience to our Users and also allowing us to authenticate your access to the Services. For example, these technologies enable us to: (i) provide you or your organization who is our Customer with our services, (ii) keep track of our Users’ preferences and authenticated sessions, (iii) secure our Services by detecting abnormal behaviors, (iv) identify technical issues and improve the overall performance of our website, (v) create and monitor analytics, (vi) identify technical issues and improve the overall performance of our services, (vii) deliver you targeted advertisements that are more tailored to you based on your browsing activities and inferred interests and track ad performance (For more information about this practice, click here: http://www.aboutads.info/choices/), and (viii) help us authenticate and allow you secure access to our Services.

Please note however that deleting any of our tracking technologies or disabling future tracking technologies may prevent you from accessing certain areas or features of our website, or may otherwise adversely affect your user experience.

MINORS

To use our Services, you must be over the age of eighteen (18). Therefore, we do not knowingly collect Personal data from minors under the age of eighteen (18) and do not wish to do so. We reserve the right to request proof of age at any stage so that we can verify that minors under the age of sixteen (16) are not using the Website.

INFORMATION SECURITY

We employ industry standard procedures and policies to ensure the safety of its Users’ Personal data, reduce the risks stemming from loss of information and prevent unauthorized use of any such information. However, no measure can provide absolute information security.

DATA RETENTION

We will retain your Personal Information only for as long as necessary to achieve the purposes for collection and processing set forth above. Retention periods will be determined taking into account the type of information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable time.

If you withdraw your consent to us processing your Personal data, we will delete your Personal data from our systems (except to the extent such data in whole or in part to comply with any applicable rule or regulation and/or response or defend against legal proceedings versus us or our affiliates).

Please Note: If you are using our QaaS, Testbed Services, and/or other Services and related services on behalf of your organization (which is our Customer), or your Personal Information has been made available to us as part of data made available by your organization as part of using the Services, and we are using and processing your information in accordance with the instructions of such Customer. You must contact your organization in order to request the deletion of your Personal Information and/or any part thereof.

YOUR RIGHTS

You may choose to stop receiving our newsletter or marketing materials by following the unsubscribe instructions included in these emails or by emailing us at: legal@quantum-machines.co.

If the law applicable to you grants you such rights, you may ask to access, correct, or delete your Personal data that is stored in our systems. You may also ask for our confirmation as to whether or not we process your Personal data. You may also request that we suspend the use of any Personal data whose accuracy you contest while we verify the status of that data.

Subject to the limitations in law, you may also be entitled to obtain the Personal data you directly provided us (excluding data we obtained from other sources) in a structured, commonly used, and machine-readable format and may have the right to transmit such data to another party. When handling these requests, we may ask for additional information to confirm your identity and your request. Please note, upon request to delete your Personal data, we may retain such data in whole or in part to comply with any applicable rule or regulation and/or response or defend against legal proceedings versus us or our affiliates.

UPDATES TO THIS PRIVACY POLICY

We reserve the right to change this policy at any time, so please re-visit this page frequently. We will notify you regarding substantial changes of this Privacy Policy by changing the link to the Privacy Policy in the Website. Such substantial changes will take effect seven (7) days after such notice was provided on our Website. Otherwise, all other changes to this Privacy Policy are effective as of the stated “Last Revised” date and your continued use of the Website after the Last Revised date will constitute acceptance of, and agreement to be bound by, those changes.

GENERAL INFORMATION

This Privacy Policy, its interpretation, and any claims and disputes related hereto, shall be governed by the laws of the State of Israel, without respect to its criminal law principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being litigated in and decided exclusively by a court of competent jurisdiction located in Tel Aviv, Israel.

This Privacy Policy was written in English, and may be translated into other languages for your convenience. If a translated (non-English) version of this Privacy Policy conflicts in any way with the English version, the provisions of the English version shall prevail.
